By downloading, installing, or using the Visi mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 13 years old to use Visi. If you are under 18, you represent that you have your parent or guardian's consent to use the App. By using Visi, you represent and warrant that you meet these eligibility requirements.
3. Your Account
You are responsible for maintaining the security of your account credentials. You agree to:
- Provide accurate and complete information when creating your account
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use Visi to:
- Send spam, unsolicited messages, or bulk communications
- Harass, threaten, intimidate, or bully other users
- Share illegal, harmful, abusive, or objectionable content
- Impersonate any person or entity
- Distribute malware, viruses, or other harmful software
- Attempt to gain unauthorised access to other users' accounts or data
- Interfere with or disrupt the App's infrastructure or services
- Use the App for any unlawful purpose
We reserve the right to remove content and suspend accounts that violate these guidelines at our sole discretion.
5. Camera and Video
Visi is a video-first messaging app. By using the App, you acknowledge that:
- Your device camera may be active during conversations when video features are in use
- Live video is transmitted peer-to-peer via WebRTC directly between devices
- Video streams are not recorded or stored on our servers
- You are responsible for your own surroundings and what is visible on camera
- You must not record, screenshot, or redistribute another user's video without their consent
6. Privacy and Encryption
Your privacy is fundamental to Visi. All messages are protected with end-to-end encryption. Please review our Privacy Policy for full details on how we collect, use, and protect your data.
7. Content and Intellectual Property
You retain ownership of content you send through Visi. By using the App, you grant us a limited licence to transmit and deliver your content to the intended recipients as part of the service.
The Visi name, logo, and App design are our intellectual property. You may not copy, modify, or distribute any part of the App without our prior written consent.
8. Third-Party Services
Visi uses third-party services to operate, including:
- Firebase (Google): Authentication, data storage, push notifications, and analytics
- WebRTC infrastructure: STUN/TURN servers to facilitate peer-to-peer video connections
These services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party providers.
9. Disclaimers
Visi is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the App will be uninterrupted, secure, or error-free. We are not responsible for the content of messages sent between users, as they are end-to-end encrypted and inaccessible to us.
10. Limitation of Liability
To the maximum extent permitted by law, Visi and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or related to your use of the App.
11. Termination
You may stop using Visi and delete your account at any time through the App settings. We may suspend or terminate your access to the App if you violate these Terms, with or without notice.
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of Visi after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Australia.
